Affiliate Terms of Service

1. Program Overview

The NuStandard Labs Affiliate Program allows approved partners to earn commissions by referring customers to NuStandard Labs. All products sold through the NuStandard Labs platform are intended strictly for in-vitro laboratory research. Products are not for human consumption.

By participating in the Affiliate Program, you agree to be bound by these Affiliate Terms of Service in addition to the NuStandard Labs Terms of Use. In the event of a conflict, these Affiliate Terms govern with respect to affiliate activities.

2. Eligibility and Approval

Participation in the Affiliate Program is subject to manual review and approval by NuStandard Labs. To be eligible, you must meet all of the following requirements:

• You must be at least 18 years of age.
• You must not promote, facilitate, or engage in any illegal activity or health fraud.
• You must agree to and comply with all terms in this document, including the content guidelines in Section 4.
• You must have a valid payment method on file to receive commission disbursements.

NuStandard Labs reserves the right to deny or revoke affiliate status at its sole discretion, including for failure to maintain compliance with these terms.

3. Commission Structure

Approved affiliates earn 15% of the order subtotal for each qualifying purchase made through their unique referral link. The cookie window for attribution is 30 days from the date a visitor first clicks the affiliate link.

The following conditions apply to commission eligibility:

• Commission rates are subject to change. NuStandard Labs will provide at least 30 days written notice before modifying the commission percentage.
• NuStandard Labs reserves the right to void commissions associated with fraudulent orders, returned merchandise, or orders subject to a payment dispute or chargeback.
• Self-referrals (using your own affiliate link to make a personal purchase) are not eligible for commission and may result in termination of affiliate status.

4. Content Guidelines (Mandatory)

All promotional materials created by affiliates must comply with the following guidelines. These requirements exist because NuStandard Labs operates under strict acquiring bank and card network compliance programs for high-risk merchants. Violations may result in the termination of NuStandard Labs payment processing, which would end the business entirely.

Required in all promotional materials:

• “For Research Purposes Only” must appear prominently on every page, post, or advertisement that references NuStandard Labs products.
• “Not for Human Consumption” must appear alongside or immediately proximate to any product name, product description, or purchase call to action.

Strictly prohibited:

• Any claim that a product diagnoses, treats, cures, or prevents any disease or medical condition.
• Any dosage guidance, administration instructions, or protocol recommendations intended for human use.
• Before-and-after claims, transformation testimonials, or any language implying personal health outcomes.
• Use of FDA terminology such as “FDA approved,” “FDA cleared,” or any language suggesting regulatory authorization for therapeutic use.
• Misleading purity or potency claims not supported by the product's Certificate of Analysis.

Examples of compliant copy:

• “NuStandard Labs offers research-grade peptides with third-party Certificates of Analysis. For research purposes only.”
• “High-purity BPC-157 available for laboratory and in-vitro research applications. Not for human consumption.”
• “Source your research compounds from a lab that publishes every COA. For research use only.”

Examples of non-compliant copy (grounds for termination):

• “BPC-157 healed my injury in two weeks.” (personal health outcome)
• “Dosing guide: inject 250mcg subcutaneously twice daily.” (human administration instructions)
• “Clinically proven to improve recovery.” (therapeutic health claim)
• “This peptide reduces inflammation and boosts immunity.” (implied health benefit)

5. Violations and Enforcement

NuStandard Labs monitors affiliate promotional materials for compliance with Section 4. The following enforcement process applies:

• First violation: Written warning with a 48-hour cure period. The affiliate must remove or correct the non-compliant material within 48 hours of receiving notice.
• Second violation: Immediate termination of affiliate status and forfeiture of any unpaid commission balance.

NuStandard Labs reserves the right to bypass the warning step and proceed directly to termination for severe violations, including but not limited to health claims, dosage instructions, or any content that creates regulatory or legal risk for NuStandard Labs.

6. Intellectual Property

NuStandard Labs grants affiliates a limited, non-exclusive, non-transferable license to use the NuStandard Labs brand name and approved logos solely for the purpose of promoting the Affiliate Program in accordance with these terms.

• Brand assets may not be modified, distorted, or combined with other imagery in ways that alter their meaning or imply endorsements not made by NuStandard Labs.
• Affiliates may not use NuStandard Labs brand assets in a way that implies endorsement of any non-research use of products.
• This license terminates immediately upon termination of affiliate status for any reason.

7. Termination

Either party may terminate participation in the Affiliate Program at any time with written notice. The following conditions apply upon termination:

• Affiliates who terminate in good standing (not for violations) will receive any earned commissions from qualifying orders placed prior to the termination date, subject to the 30-day cookie window and standard order validity requirements.
• Affiliates terminated for violations of these terms forfeit all unpaid commissions.
• Upon termination for any reason, affiliates must remove all NuStandard Labs promotional materials, including affiliate links, brand assets, and product references, within 7 days.

8. Limitation of Liability

The Affiliate Program is provided “as is.” NuStandard Labs makes no guarantees regarding commission volume, program continuity, or earning potential. Commission rates, cookie windows, and program rules are subject to change with 30 days written notice.

NuStandard Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in the Affiliate Program, including lost profits or lost commissions due to program changes or termination.

9. Governing Law

These Affiliate Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
